JOB OVERVIEW

OBJECTIVE:
To develop a comprehensive set of legal documents for partition and forced sale lawsuits in each US State, which will be used by individuals representing themselves in such legal matters and by attorneys. The end product will be a robust set of legal documents tailored to the nuances of partition and forced sale lawsuits in each state, capable of guiding self-represented individuals through their legal proceedings efficiently and effectively.

This project involves detailed legal research, process mapping, and document template creation, focusing only on partition actions, and focusing only on one US state at a time. The role requires strong critical thinking skills so that you can map out the different possible routes a lawsuit could take depending on different factual scenarios, in the form of a logic tree or a flowchart.

RESPONSIBILITIES:

Review State Statutes: Identify and study statutes relevant to partition and forced sale lawsuits in the current state. Pay particular attention to any special provisions, such as the Partition of Heirs Property Act.

Analyze Case Law: Review case law to understand judicial interpretations and applications of the relevant statutes in the current state.

Examine Filed Cases: Obtain and review publicly available pleadings and documents from actual partition and forced sale lawsuits filed in the current state.

Categorize Lawsuits: Determine the different types of partition and forced sale lawsuits that can be filed in the current state. This includes understanding distinctions like standard partition actions versus those involving heirs property.

Outline Legal Paths: Map out the different procedural paths a partition or forced sale lawsuit can take once filed, based on state laws and case examples.

Create Flowcharts: Develop detailed flowcharts or logic trees that depict the various types of partition lawsuits and their procedural paths for the current state. Include all potential branching points and alternative routes based on different scenarios.

When this is completed, the role will switch to improving, updating, and maintaining the existing forms, so this is a position with long-term potential and potential for growth.
