Attorney – Texas SMS/Telemarketing Compliance

Location: Remote (Texas license preferred)
Engagement: Contract / Part-Time / Project-Based

About Us

We are a fast-growing digital media and marketing company with national reach, specializing in email and SMS campaigns in the financial and political space. With the passage of Texas SB 140, we are seeking an experienced attorney to ensure our compliance with the Texas Telephone Solicitation Act, TCPA, and related consumer protection statutes.

Role Overview

We are looking for an experienced attorney who can serve as outsourced counsel to guide us through compliance obligations under the new Texas SMS law and related telemarketing regulations.

You will:

Review our current SMS marketing practices, consent procedures, and scripts.

Advise on Texas SB 140 compliance, including:

Registration with the Texas Secretary of State (Form 3401).

Surety bond/security deposit requirements.

Exemption qualification review.

Required disclosures and consumer rights.

Draft or review compliance attachments (officer disclosures, scripts, supplier information, giveaways, etc.).

Provide guidance on risk exposure under the Texas Deceptive Trade Practices Act (DTPA).

Create or refine compliance checklists, disclaimers, and record-keeping policies.

Be available for ongoing consultation as laws or enforcement actions evolve.

Qualifications

J.D. with active license to practice law (Texas Bar strongly preferred).

3+ years of experience in telemarketing, SMS marketing, TCPA, or consumer protection law.

Familiarity with Texas Business & Commerce Code, Chapter 302 and related statutes.

Experience drafting compliance filings with state regulatory agencies.

Strong ability to simplify legal requirements into clear, actionable steps for a business team.

Preferred

Prior experience working with marketing agencies, call centers, or SMS platforms.

Litigation defense experience in TCPA/DTPA matters.

Ability to work quickly and independently with minimal oversight.
